How to file online police complaint in West Bengal

Introduction:

Generally speaking, FIR means the First Information Report. It is made when police receive information about a criminal offence. Usually, it is a complaint made by the victim of a cognizable crime or by relatives, friends or known person on behalf of the victim person, but anyone can make such report orally or in writing to the police.People can also submitan FIR online. Most people are scared to go to the police station if any crime takes place. Usually, many people think that registering a complaint at a police station is a hassle or the police will not cooperate properly. However, no one should be prevented from taking action against crime.When you go to the police station, you have to file a First Information Report (FIR) or complaint. An FIR can be filed by the person who witnessed the crime or against whom the crime was committed.The procedure for lodging an FIR is referred to under Section 154 of the Code of Criminal Procedure, 1973. An e-FIR is filed for the heinous crimes like murder, rape, murder for dowry, kidnapping etc. In this case, the police can arrest without a court order. Complaints can only be filed online for non-cognizable crimes such as assault, cheating, larceny, etc. Later, the police may change it into an FIR with the permission of the magistrate. There is a facility to submit FIR online in West Bengal.In West Bengal, you can file an online FIR to Kolkata Police or West Bengal Police.

To file an FIR online, you must first open the website of Kolkata Police or West Bengal Police on the Internet. By opening the FIR page on the website, you can make an FIR by filling a specific form online. After completing the form fill up you need to submit the form an take a screenshot of the FIR copy to save it in your computer.

Follow these simple steps to submit an online FIR:

Step 1: Open the Kolkata police or West Bengal police official website.

Step 2: By scrolling down you may select “service” option.

Step 3:If you would like to file a police complaint online then choose the alternative complaint option from the online service box.

Step 4:A form will appear in front of you where you will have to fill out several fields.

Step 5:Now choose the type of complaint from the given box.

Step 6:Next, you will need to describe your problem in detail. Your complaint must be written in a maximum of2000 words.

Step 7:In the next section, you will need to fill your personal details such as name, address, mobile number, etc.

Step 8:After filling the all fields, hit the submit button for final submission you FIR.

Important points to remember:

  • Fill the name of the person in the given box who wants to lodge an FIR.
  • Fill the complainant’s parents’ name in the given box.
  • Enter the full address of the person who wants to complain.
  • Give the mobile number.
  • Provide Email-ID because a copy of your e-FIR will be sent to you via email.

Case Analysis: “State vs. Raju Mukherjee on December, 2019”

“Charge Framed Against The Accused:­ Charge for offences punishable u/s. 379/411 IPC was framed against the accused, to which he pleaded not guilty and claimed trial.”

“PW1 is Ms. Pooja. The said PW was the complainant in the instant matter, who deposed that on 12.07.2019, she left her home for her job for Paharganj and reached at R.K. Ashram Metro Station and when she was getting out of R.K. Ashram Metro and going towards New Delhi Railway Station at about 2.00 pm, he reached at New Delhi Railway Station, then one boy came and asked for her mobile phone for making a call. She further deposed that the said boy after making a call ran away with her mobile phone. She made an online complaint. Police recorded his statement which is Ex. PW1/A. Police also prepared site plan at this instance, which is Ex. PW1/B. PW2 was cross examined by Ld defence counsel at length. Accused is present in the court and correctly identified by the witness. Witness stated that he was the same person, who ran away with my mobile phone.”

“In the present case, convict has been convicted for offences punishable u/s. 379/411 IPC. Convict is a young boy aged about 25 years. Convict has already spent many days in judicial custody during the trial of the present case. Keeping in view the facts and circumstances, I am of considered view that ends of justice would be met if the convict is sentenced to SI for the period already undergone by him during the trial of present case. Convict is sentenced accordingly.”

It is concluded that the plaintiff’s mobile phone was theft by a person then the plaintiff made an online complaint regarding the case and the police took necessary steps against the accused. The accused has been convicted for offences which is punishable under section 379 and 411 of IPC. The accused is sentenced accordingly.

Conclusion:

Finally, it can be said that online police FIR is not a very difficult task, but it is necessary to be conscious when someone lodging online complain.
